Terms of Service (DSA compliant)

These Terms of Service define the terms and conditions for using the hosting services provided by PhenixHosting.eu (hereinafter referred to as „Service Provider” or „We”). This document has been prepared in accordance with Regulation (EU) 2022/2065 of the European Parliament and of the Council – Digital Services Act (DSA).
1. Information about the Service Provider

2. Scope of Services
PhenixHosting.eu provides hosting services, including:
– website hosting,
– VPS servers,
– game servers,
– domain registration,
– additional services (e.g., DDoS protection, SSL certificates).
These services constitute indirect services within the meaning of the DSA.
3. Terms of Service
The User agrees to use the services in accordance with:
– applicable law,
– these Terms of Service,
– principles of social coexistence,
– good technical practices. It is prohibited to use the services for:
– hosting illegal content,
– copyright infringement,
– phishing, fraud, malware, botnets,
– DDoS attacks or other harmful activities,
– disseminating extremist content, incitement to violence, child pornography, or hate speech.
4. Content Moderation
PhenixHosting.eu may take action against a user’s content or services if:
– it is illegal,
– it violates the Terms of Service,
– it poses a threat to infrastructure security,
– it is reported by public authorities or trusted whistleblowers.
Possible actions:
– removal of content,
– restriction of access,
– account suspension,
– contract termination,
– urgent blocking of services.
Each moderation decision is justified and communicated to the user electronically.
5. Procedure for Reporting Illegal Content (Notice & Action)
Any user or third party may report illegal content hosted by PhenixHosting.eu clients. The report must include:
– the exact URL or location of the content,
– a description of why the content is illegal,
– the reporting party’s contact information,
– a statement of good faith.
Reports are accepted at:

Reports are reviewed without undue delay.
After a decision is made, we inform the reporting party and the user concerned.
6. Appeals against moderation decisions
The user has the right to appeal any decision concerning:
– removal of content,
– limitation of visibility,
– account suspension,
– service blocking.
Appeals should be sent to:

We review appeals within 14 days.
The user also has the right to seek alternative dispute resolution pursuant to Article 21 of the Dispute Resolution Act.
7. Algorithm Transparency
PhenixHosting.eu does not use algorithmic content recommendation systems or automated user profiling within its hosting services.
All moderation decisions are made manually or semi-automatically, with human involvement.
8. Advertising and Profiling
PhenixHosting.eu:
– does not display targeted advertising,
– does not conduct behavioral targeting,
– does not sell user data to third parties.
If advertising appears in the future, the user will be informed in a manner consistent with the DSA.
9. Service Provider Liability
In accordance with the DSA:
– we do not actively monitor user content,
– we are not responsible for content hosted by customers,
– we respond to reports of illegal content in accordance with the Notice & Action procedure.
10. Technical Restrictions and Security
The Service Provider may temporarily restrict the operation of services in order to:
– repair faults,
– perform maintenance,
– protect infrastructure from attacks. The user will be informed of planned maintenance breaks.

12. Changes to the Terms and Conditions
These Terms and Conditions may be updated in the event of:
– changes in law,
– changes in services,
– technical requirements.

13. Entry into Force
These Terms and Conditions come into force on the date of their publication on the PhenixHosting.eu website.
